These Terms of Use govern access to and use of studiolowsheen.com and the websites, publications, editorial features, private communications, catalogues, newsletters, restricted pages, digital material, and related services made available by Studio Lowsheen.

By accessing or using the Website or Services, you agree to these Terms of Use.

If you do not agree to these Terms, you should not access or use the Website or Services.

Certain commercial, editorial, publication, cultural positioning, communications, or other engagements with Studio Lowsheen may also be governed by a separate written proposal, engagement letter, service agreement, or other written terms.

Where a separate written agreement applies to a particular engagement, that agreement will govern the relevant engagement to the extent of any inconsistency with these Terms.

ABOUT STUDIO LOWSHEEN

Studio Lowsheen is an editorial, curatorial, and cultural communications platform covering estates, architecture and interiors, hotels and restaurants, galleries and museums, and art and objects.

Studio Lowsheen publishes and circulates editorial material concerning places, projects, institutions, people, objects, works, and subjects of cultural, architectural, historical, material, or aesthetic interest.

Its activities may include editorial publishing, cultural positioning, selected publication and placement, private communications, newsletters, catalogues, professional audience circulation, directed outreach, invitations, qualified introductions, and related editorial, curatorial, and communications services.

Studio Lowsheen determines the subjects, material, and professional communities with which the platform engages.

Unless expressly agreed otherwise in writing, Studio Lowsheen does not act as the agent, broker, fiduciary, representative, or exclusive adviser of a reader, client, featured party, or third party.

EDITORIAL SUBJECTS AND CONTENT

Studio Lowsheen may publish material concerning estates, private residences, architectural projects, interiors, hotels, lodges, resorts, restaurants, galleries, museums, institutions, exhibitions, artists, designers, historical works, ancient objects, painting, sculpture, collectible design, and related cultural subjects.

Content may include editorial writing, photography, visual essays, interviews, profiles, historical information, project descriptions, selected objects or works, digital features, newsletters, catalogues, private communications, and links or references to third parties.

Studio Lowsheen determines the editorial structure, wording, context, visual presentation, image selection, sequencing, format, circulation, timing, and continued availability of material published through its platforms.

Studio Lowsheen may edit, update, correct, expand, archive, restrict, or remove published material where reasonably considered appropriate.

EDITORIAL AND COMMERCIAL ARRANGEMENTS

Studio Lowsheen may undertake paid or otherwise commercially supported engagements in connection with publishing, editorial development, cultural positioning, selected placement, communications, catalogue presentation, audience circulation, professional outreach, and related services.

Payment or another commercial arrangement does not transfer ownership or control of the Studio Lowsheen platform, audience, editorial format, mailing infrastructure, professional network, or publication systems to a client or featured party.

Unless expressly agreed otherwise in writing, Studio Lowsheen retains direction over editorial wording, visual presentation, layout, publication format, circulation method, sequencing, and the relationship of material to the broader Studio Lowsheen platform.

Studio Lowsheen may decline a proposed subject or engagement where it does not consider the material appropriate for the platform.

Acceptance of a fee or commercial engagement does not constitute a guarantee that Studio Lowsheen will make statements, claims, recommendations, or representations that it considers inaccurate, unsupported, unlawful, or materially inconsistent with the platform.

Where required by applicable law, applicable platform rules, or an applicable regulatory or industry requirement, Studio Lowsheen may identify or otherwise disclose the commercial nature of an arrangement.

The Australian Consumer Law prohibits misleading or deceptive conduct, including in advertising and promotional activity, and the ACCC has specifically warned that commercial relationships can create legal issues where audiences are misled about sponsored material. The AANA Code also provides that advertising must be clearly distinguishable as such to the relevant audience. 

CLIENT SERVICES AND SEPARATE ENGAGEMENTS

Studio Lowsheen may provide editorial, publication, cultural positioning, circulation, communications, outreach, or related services to clients.

The specific scope, fee, timing, deliverables, publication arrangements, or other commercial terms of a client engagement may be described in a separate written proposal, invoice, engagement letter, or agreement.

Unless expressly stated in the applicable written agreement, Studio Lowsheen does not guarantee:

Sales;

Bookings;

Acquisitions;

Investment;

Press coverage;

Publication by third parties;

Website traffic;

Audience growth;

Social media growth;

Inquiries;

Introductions;

Project specifications;

Collector interest;

Commercial conversion; or

Any particular financial or commercial result.

Studio Lowsheen may report on publication, circulation, audience reach, geographic reach, engagement, communication activity, or other relevant performance information where such information is reasonably available.

Performance information may be affected by third-party platforms, technical systems, privacy controls, device settings, measurement methodologies, and other factors outside Studio Lowsheen's control.

AUDIENCE CIRCULATION AND PROFESSIONAL OUTREACH

Studio Lowsheen may circulate selected editorial or professional material to readers and professional contacts considered relevant to a publication, subject, sector, geographic territory, or professional opportunity.

Studio Lowsheen may organise its professional audience and communications activity by factors including professional sector, geographic territory, role, existing relationship, previous correspondence, expressed interest, and engagement with Studio Lowsheen material, subject to the Privacy Policy and applicable law.

A client, featured party, or collaborator does not acquire ownership of or unrestricted access to Studio Lowsheen's mailing lists, subscriber information, professional contact databases, audience information, or relationship records solely because Studio Lowsheen undertakes an engagement concerning that party.

Studio Lowsheen determines its own circulation and outreach processes unless otherwise expressly agreed in writing.

A representation concerning the size, composition, territory, or professional character of a Studio Lowsheen audience or contact network describes the relevant information reasonably available to Studio Lowsheen at the time the representation is made.

Audience and contact information may change over time.

INQUIRIES AND QUALIFIED INTRODUCTIONS

Users may contact Studio Lowsheen concerning material presented through the Website, publications, newsletters, private communications, or other Services.

Studio Lowsheen may respond to an inquiry, provide further context, direct an individual to a relevant third party, or facilitate an introduction where Studio Lowsheen considers this appropriate.

Unless expressly stated otherwise, Studio Lowsheen does not act as the seller, accommodation provider, restaurant operator, property vendor, gallery, museum, artist, dealer, broker, shipping provider, payment processor, insurer, or fulfilment provider for third-party subjects presented through the Website or Services.

A user may be directed or introduced to a property owner, hotel, restaurant, architect, interior designer, gallery, museum, institution, artist, designer, dealer, representative, broker, studio, or other third party.

Any subsequent booking, purchase, acquisition, sale, commission, appointment, negotiation, investment, supply arrangement, payment, delivery, shipping, insurance, tax, duty, customs process, or other transaction takes place subject to the arrangements and terms agreed between the relevant parties.

Studio Lowsheen is not a party to a third-party transaction solely because the relevant subject was published, circulated, featured, or introduced through Studio Lowsheen.

ART, OBJECTS, AND SELECTED WORKS

Artworks, antiquities, ancient objects, furniture, collectible design, sculpture, painting, architectural elements, and other works or objects may be presented through Studio Lowsheen.

Unless expressly stated otherwise, Studio Lowsheen is not the owner, seller, dealer, consignee, or agent for a work or object presented through the Website or Services.

Any question concerning price, availability, attribution, authenticity, authorship, provenance, title, ownership, condition, restoration, valuation, cultural property status, export, import, tax, duty, insurance, delivery, or acquisition should be independently confirmed with the relevant owner, gallery, dealer, artist, designer, representative, adviser, or other appropriate party.

Studio Lowsheen does not provide an authenticity, provenance, valuation, title, condition, cultural property, tax, customs, investment, or legal warranty concerning third-party works.

ESTATES, ARCHITECTURE, INTERIORS, AND PROPERTY MATERIAL

Studio Lowsheen may publish properties, estates, private residences, architectural projects, interiors, developments, and related places.

Publication by Studio Lowsheen is not a building inspection, property valuation, planning assessment, heritage assessment, engineering report, architectural certification, legal due diligence review, or investment recommendation.

Unless expressly agreed otherwise in writing, Studio Lowsheen does not act as a real estate agent, buyer's agent, selling agent, property manager, valuer, or broker in relation to a featured property.

Information including property history, construction date, architect or designer attribution, project descriptions, ownership history, sale information, location, dimensions, or other characteristics may be based on information supplied by owners, architects, designers, brokers, publications, archives, or other sources.

Users should independently verify information material to any property, investment, acquisition, construction, or professional decision.

HOTELS, RESTAURANTS, AND HOSPITALITY MATERIAL

Studio Lowsheen may publish hotels, lodges, resorts, restaurants, dining spaces, and other hospitality subjects.

Unless expressly stated otherwise, Studio Lowsheen does not operate featured hospitality venues, process bookings, determine availability, establish prices, manage cancellations, or provide hospitality services on behalf of a featured party.

Information concerning opening periods, facilities, services, menus, accommodation, availability, or other hospitality matters may change.

Users should confirm current information directly with the relevant operator before making a booking or other decision.

GALLERIES, MUSEUMS, AND CULTURAL INSTITUTIONS

Studio Lowsheen may publish galleries, museums, foundations, exhibitions, collections, and other cultural institutions or programmes.

Studio Lowsheen does not control exhibition dates, admission conditions, institutional policies, opening hours, work availability, or changes to third-party programming.

Users should verify time-sensitive information directly with the relevant institution or organiser.

EDITORIAL INFORMATION AND ACCURACY

Studio Lowsheen makes reasonable efforts to prepare and present material accurately.

Editorial material may rely on information supplied by clients, owners, operators, architects, interior designers, galleries, institutions, artists, designers, representatives, photographers, press offices, archives, publications, and other third-party sources.

Studio Lowsheen does not guarantee that all information is complete, continuously current, or free from error.

Historical, architectural, artistic, cultural, and attribution information may involve interpretation, differing sources, or subsequent research.

Studio Lowsheen may correct or update material where it considers this appropriate.

Content published by Studio Lowsheen is provided for editorial, cultural, and general informational purposes and is not legal, financial, investment, valuation, tax, customs, conservation, engineering, planning, medical, or other regulated professional advice.

PRIVATE COMMUNICATIONS AND RESTRICTED CONTENT

Studio Lowsheen may provide access to private communications, catalogues, password-protected pages, invitation-only publications, selected material, or other restricted content.

Access may be granted to selected recipients at Studio Lowsheen's discretion.

Any termination or cancellation rights applying to a paid service remain subject to the relevant written agreement and applicable law.

The Website and Studio Lowsheen communications may contain links or references to third-party websites and services.

Studio Lowsheen does not control third-party websites, booking systems, payment services, sales processes, communications, privacy practices, terms, availability, pricing, or technical systems.

A user's use of a third-party website or service is governed by the relevant third party's own terms and policies.

To the extent permitted by law, Studio Lowsheen is not responsible for loss caused solely by the acts, omissions, representations, systems, or services of an independent third party over which Studio Lowsheen has no control.

INTELLECTUAL PROPERTY

Unless otherwise stated, content created by Studio Lowsheen, including original editorial writing, branding, graphics, publication formats, page layouts, catalogue formats, selection and arrangement of original material, and other original Studio Lowsheen content, is owned by or licensed to Studio Lowsheen.

Third-party photographs, artworks, designs, architectural works, objects, logos, names, trade marks, and other third-party material remain subject to the rights of their respective owners.

Nothing in the Website or Services transfers ownership of intellectual property to a user.

Users must not reproduce, republish, commercially exploit, sell, license, systematically scrape, or distribute Studio Lowsheen content without permission except where permitted by law.

Nothing in these Terms is intended to restrict a use expressly permitted by applicable copyright law.

IMAGE CREDITS AND THIRD-PARTY MATERIAL

Studio Lowsheen may publish photographs, architectural images, interiors photography, artwork images, object images, installation views, archival images, project material, press material, or other visual content supplied or made available by third parties.

Studio Lowsheen seeks to identify sources and rights holders where known and appropriate.

A person who believes material has been incorrectly credited or used without appropriate authority may contact info@studiolowsheen.com and provide sufficient information to identify the material and the basis of the concern.

Studio Lowsheen may investigate, correct, update, restrict, or remove material where it considers this appropriate.

MATERIAL PROVIDED TO STUDIO LOWSHEEN

A person who provides photographs, text, project information, biographies, press material, links, logos, artwork information, architectural material, property information, or other content to Studio Lowsheen confirms that they are authorised to provide that material for the purpose for which it is submitted.

Where material is submitted for possible publication, circulation, or use in a Studio Lowsheen engagement, the submitting party grants Studio Lowsheen a non-exclusive, worldwide licence to review, edit, format, reproduce, communicate, publish, and distribute that material for the relevant Studio Lowsheen publication, service, engagement, and reasonable promotion of that publication or engagement.

This licence does not transfer ownership of the underlying material to Studio Lowsheen.

The submitting party must inform Studio Lowsheen of any material restrictions, credit requirements, embargoes, geographic limitations, or usage conditions before publication or use.

Studio Lowsheen may decline, edit, shorten, or remove submitted material.

PROHIBITED USE

Users must not:

Access or use the Website in breach of applicable law;

Knowingly interfere with Website security, availability, or technical operation;

Attempt to bypass access restrictions or security controls;

Use stolen, improperly obtained, or unauthorised access credentials;

Systematically scrape or extract Studio Lowsheen content for commercial exploitation without permission;

Falsely represent an identity, professional affiliation, authority, ownership interest, or relationship with Studio Lowsheen;

Submit material the user knows they are not authorised to provide;

Use Studio Lowsheen content in a manner that infringes third-party rights; or

Use the Website or Services for unlawful or fraudulent activity.

Studio Lowsheen may take reasonable steps to protect its Website, content, restricted material, users, and systems against prohibited use.

WEBSITE AVAILABILITY

Studio Lowsheen may update, maintain, modify, or temporarily suspend parts of the Website.

Studio Lowsheen does not guarantee uninterrupted or error-free Website access.

Website material may be archived, corrected, reorganised, restricted, or removed.

Where Studio Lowsheen has a separate contractual obligation to provide a paid service, changes to the public Website do not alter that obligation except in accordance with the applicable agreement or law.

AUSTRALIAN CONSUMER LAW AND NON-EXCLUDABLE RIGHTS

Nothing in these Terms excludes, restricts, or modifies a guarantee, right, remedy, or liability that cannot lawfully be excluded, restricted, or modified.

Where the Australian Consumer Law applies, users may have statutory rights and consumer guarantees in relation to goods or services supplied by Studio Lowsheen.

These rights operate in addition to any rights expressly provided under these Terms or a separate agreement.

Any limitation or exclusion in these Terms applies only to the extent permitted by law.

This savings language is important because the ACL expressly provides that applicable consumer guarantees cannot be excluded by contract. 

NO ADDITIONAL WARRANTIES

Subject to applicable law and any express written agreement, the Website and general public Services are provided on an as-available basis.

Studio Lowsheen does not provide an additional warranty that the Website will be continuously available, completely error-free, or suitable for a particular user's individual commercial purpose.

No statement in this section excludes a statutory guarantee or other right that cannot lawfully be excluded.

LIMITATION OF LIABILITY

To the extent permitted by law, Studio Lowsheen is not liable for indirect or consequential loss arising solely from a user's use of the public Website or reliance on general editorial content.

Studio Lowsheen is not liable for the independent acts or omissions of third parties merely because Studio Lowsheen published, referenced, linked to, circulated material concerning, or facilitated an introduction to that third party.

Nothing in these Terms excludes or limits liability to the extent that the liability cannot lawfully be excluded or limited.

Any liability relating to a specific paid Studio Lowsheen engagement may also be governed by the applicable written agreement.

INDEMNITY

To the extent permitted by law, a user is responsible for loss, liability, or reasonable costs incurred by Studio Lowsheen to the extent directly caused by:

The user's material breach of these Terms;

The user's unlawful or fraudulent conduct;

The user's unauthorised commercial exploitation of Studio Lowsheen content; or

Material submitted by the user in circumstances where the user did not have the rights or authority they represented they held.

This section does not require a user to indemnify Studio Lowsheen for loss to the extent caused by Studio Lowsheen's own unlawful conduct, negligence, or breach of applicable obligations.

This is deliberately narrower than your existing indemnity. Broad one-sided indemnities and terms allowing one party excessive unilateral control can be relevant to unfair-contract-term analysis under the ACL. 

PRIVACY AND COOKIES

Studio Lowsheen's handling of personal information is described in its Privacy Policy.

Studio Lowsheen's use of cookies and similar technologies is described in its Cookie Policy.

The Privacy Policy and Cookie Policy should be read together with these Terms where relevant to a user's use of the Website or Services.

RESTRICTION OF ACCESS

Studio Lowsheen may restrict or suspend access to the public Website or restricted material where reasonably necessary to:

Address a security or technical risk;

Protect restricted or confidential material;

Respond to unlawful or fraudulent use;

Prevent material misuse of Studio Lowsheen content;

Comply with a legal obligation; or

Respond to a material breach of these Terms.

Where access forms part of a separately paid contractual service, termination, suspension, refund, or cancellation rights are also subject to the applicable written agreement and mandatory law.

CHANGES TO THESE TERMS

Studio Lowsheen may update these Terms to reflect changes to the Website, Services, business activities, or applicable legal requirements.

The current version will be published on the Website with its effective date.

Changes will apply prospectively from the stated effective date unless applicable law requires otherwise.

Changes to these Website Terms do not retrospectively alter the agreed scope, fee, or material contractual rights of a separate client engagement unless the relevant parties agree or applicable law otherwise permits.

SEVERABILITY

If a provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be interpreted or severed to the extent necessary and permitted by law.

The remaining provisions will continue to operate to the extent they are capable of doing so.

GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

Subject to any mandatory right or jurisdiction that cannot lawfully be excluded, disputes concerning these Terms are subject to the jurisdiction of the courts of New South Wales and courts competent to hear appeals from those courts.
